1982 (CGT rebase) Property / Land Valuations

When disposing of an interest (whether by sale or other transfer) in property or land acquired before 1 April 1982 and disposed of after 5 April 1988 a Capital Gains Tax (CGT) liability may arise. Capital Gains Tax was ‘rebased’ to 31 March 1982 in The Finance Act 1988. Rebasing is achieved by deeming any asset held at 31 March 1982 to have been sold and immediately reacquired at its market value on that date. The effect is that tax is normally charged only on gains which are attributable to the period since that date. For this reason you will need a valuation of the property on the basis of Market Value as at 31 March 1982. Market Value is as defined in Section 272 of the Taxation of Chargeable Gains Act (TCGA) 1992.

Our 1982 (CGT rebase) Property / Land Valuation Summary
  • 1982 (CGT rebasing) valuations are provided by a Chartered Surveyor and Registered Valuer. We are also very familiar with HMRC’s reporting requirements, one of our Directors having previously been a Senior Valuer at The Valuation Office Agency, the agency of HMRC entrusted with such matters.
  • If the property can be inspected, then it will involve both an internal and external inspection, where the property is measured and photographed.
  • Detailed research on any available comparable evidence (other properties of similar size, age and location) is undertaken using comparative techniques and information obtained from our comprehensive databases and historic data sources in order to establish a 31 March 1982 valuation.
  • A detailed written RICS Redbook Valuation report is provided which complies with RICS international valuation standards and in a form consistent with HMRC/VOA expectations of such a report.
  • Post valuation support is provided by phone and email. When necessary we are well equipped to negotiate on your behalf.
What Happens if the Surveyor/Valuer cannot get access the property?

Capital Chartered Surveyors will always request access to the property so that they can inspect. However, there may be times when this is not possible, for example if the property has been sold. We can still carry out a 1982 valuation from information supplied and by investigating previous sales details, comprehensive databases and historic data sources.
