Many leaseholders of top floor apartments consider building over flat roofs into the air space (like a loft conversion) to increase the size and value of their flat.

Airspace above a flat roof is rarely demised within the lease so the leaseholder usually has to buy the airspace from the freeholder. Where the lease does include the airspace there may be an absolute ban or prohibition on alterations and extensions. In such a case the freeholder’s consent will have to be obtained for which a premium is usually payable.

At this point, buyer and seller require valuations to establish the premium (price) payable to the freeholder to acquire the space and/or consent for development.

The leaseholder and the freeholder may obtain their own, separate, valuations but as an alternative it is often most cost effective to commission a single valuation report on a jointly instructed basis.
